1.0 General information

This document regulates the conditions of sale between TSUNAMI SURFING SHOP, an electronic shop of Communications And Technolgies (in the name and hereinafter simply Shop or TSS) and the natural person who purchases the goods (hereinafter simply Buyer).

No one is authorized, other than TSS itself, to carry out commercial actions and initiatives in the name tsunamisurfing.com/shop.

If you are a new customer, we would need to know the following data:

1. Surname and name

2. Complete residential address

3. Address for shipping the goods (there is no need to write it down if it is the same as your residence)

4. Telephone number

5. Tax code

6. Email for communications

The stored data will be processed exclusively by TSS to carry out the economic transaction and will not, in any way or direction, be shared with third parties.

In line with the DGPR, at any time the user can carry out and/or request the deletion of all his data in our possession.

2.0 Conditions of sale

- all retail prices include VAT; shipping costs and taxes are visible separately;

- the minimum price for an order to be validated is €39.00 (taxes excluded);

- the shipment will always be accounted for with a regular invoice. The invoice will be inserted into the user profile accessible via authentication at our electronic shop.

- Product prices and commercial offers published on tsunamisurfing.com/shop are subject to variations depending on the vintages, the various types of packaging and the different formats. For this reason the Store reserves the right to make changes to the price list and packaging methods at any time and without notice.

PLEASE NOTE THAT THE SELECTED PRODUCT EVEN IF AVAILABLE IN THE PRODUCT CATALOGUE MAY NOT BE AVAILABLE AT THE TIME OF PURCHASE IN CONSIDERATION OF THE FACT THAT THE PRODUCT CATALOG PUBLISHED ON THE PORTAL ALLOWS MULTIPLE USERS ACCESS AND THE POSSIBILITY OF SUBMITTING AN ORDER ONLINE BY MODIFYING THE AVAILABILITY OF THE PRODUCTS THEMSELVES IN REAL TIME.

3.0 Payments

N.B. OUR STORE DOES NOT OFFER EXTENSION OF PAYMENTS THROUGH ANY ECONOMIC FORM.

The Buyer can choose one of the following payment methods:

- Credit Card (at the user's request, partial discounts applied) VISA or MASTERCARD through the interbank circuit. Your data will be used solely and exclusively for the current transaction and all discounts will not be applied to the total price.

- PayPal (at the user's request, partial discounts applied)

IT IS NOTED THAT PAYPAL APPLIES COMMISSIONS TO MERCHANTS ON THE MOVEMENT OF MONEY AND NOT ON THE ORDER PLACED. THEREFORE, ANY PAYMENT REFUND CAN BE MADE EXCLUSIVELY AFTER PAYMENT OF THE FEES APPLIED FOR THE ECONOMIC MOVEMENT THAT HAS OCCURRED (approximately 7%).

- Bank Transfer: where the Buyer chooses this payment method, the order will remain in the status "Awaiting payment by Bank Transfer" and as soon as confirmation of payment has been received, the Store will proceed with the regular processing of the order. The delivery terms will start from the moment the order begins to be processed.

4.0 Shipping

Consult the delivery times and costs page for logistical information.

If goods are ordered that are "not available" in stock, delivery is estimated within 20 working days.

Delivery within the expected deadlines will only be made if the customer has communicated exact information to the Store regarding the recipient's contact details. In the event of an error, TSS will not be held responsible for the impossibility of delivering the goods to the desired place and time.

Upon receiving the goods, the customer is required to verify the integrity of the goods. If the goods appear damaged or in a smaller quantity than expected, the Buyer must refuse unloading, specifying the problem on the delivery note. Within 24 hours after the event, you must inform the carrier by registered letter with return receipt (with copy to TSS) in order to preserve your rights.

5.0 Condition of validity for withdrawal

As established by current regulations, the Buyer has 14 days from receipt of the goods to exercise his right of withdrawal. We would like to point out that this right expressly sanctioned by the so-called "consumer code" Legislative Decree. n.206 of 2005, also establishes that the goods must be returned in the same conditions in which they were received. Therefore the packaging must be intact. The right of withdrawal gives the customer the opportunity to change his mind after purchasing and does not in any way enter into discussions on the warranty and replacement.

No packages, packaging or objects that have been used or are not in their original condition will be accepted.

The goods must be returned to Tsunami Surfing Shop at the address that will be communicated upon acceptance of the right of withdrawal. This address can also be located outside Italy.

Once the item or items have reached us and after having checked the condition of the goods, if it corresponds to the standards mentioned above, within 30 working days we will refund the Buyer the total amount of his purchase, including shipping costs initials.

In the case of payment through the PAYPAL circuit, the costs of the commission applied by the same equal to or approximately 12% plus a variable percentage of the amount paid will be withheld (the percentage is established by PAYPAL and is subject to variations).

ATTENTION: as established by the European Court of Justice, the costs that the Buyer will incur to return the goods will not be reimbursed.

6.0 Damages, Complaints & Returns

All products are shipped with suitable packaging. If at the time of delivery the cartons are damaged, tampered with, or with obvious signs of breakage, the customer MUST refuse the collection, citing the reason in the delivery note. If the unloading is accepted, it will not be possible to claim the insurance against damage/damage.

RETURN/ WITHDRAWAL - Procedure to follow

Send within 24 hours of receipt, an email to shop@tsunamisurfing.com containing the declaration of intention to exercise the right of withdrawal, indicating all the requested data:

     - order number and order date

     - invoice number

     - which products must be subject to withdrawal

     - your bank details (IBAN code)

Then wait for a communication from our Customer Service authorizing the return.

Upon receipt of this communication, return the goods in question within 5 days to the address that will be communicated. This address can also be located outside Italy.

Upon arrival at the warehouse, the goods will be examined to assess any damage or tampering (the substantial integrity of the returned goods is an essential condition for exercising the right of withdrawal) therefore we recommend maximum attention when preparing the package using the original packaging.

Refund times

TSUNAMI SURFING SHOP undertakes to reimburse the Buyer within 14 working days of receipt of the goods by crediting the Buyer with the amount corresponding to the value of the goods resulting from the invoice. Shipping costs are not included in the aforementioned amount. This is in compliance with the art. 5, paragraph 6, Legislative Decree no. 185 of 05/22/1999.

7.0 Applicable law and jurisdiction

The concluded contracts are governed by Italian law. In particular, the provisions of articles 50 et seq. apply to them. of the Consumer Code. For any dispute relating to the application, execution, interpretation of these General Conditions of Sale, the Court of Latina is competent.
